Terms of Service

These Terms of Service ("Terms") govern your use of the OneAthlete mobile app. By using OneAthlete, you agree to these Terms.

1. The Service

OneAthlete provides guided audio sessions, performance reflections, personalized recommendations, and an AI mental-performance coach to help athletes prepare, perform, recover, and sleep.

2. Not Professional Advice

OneAthlete does not provide medical, mental-health, legal, financial, nutritional, or other professional advice. The app's content and AI responses are for general informational and self-reflection purposes.

You are responsible for decisions about your health, training, competition, and safety. Consult qualified professionals where appropriate.

If you are in crisis, feel unsafe, or may harm yourself or someone else, contact local emergency services or a crisis service immediately. OneAthlete is not an emergency service.

3. Safe Use

Do not use audio sessions, breathing exercises, or the AI coach while driving, operating machinery, or doing anything that requires your full attention.

Stop any exercise that causes pain, dizziness, severe distress, or other concerning symptoms. Consult a qualified healthcare professional before beginning or changing training or breathing practices if you have a relevant health condition.

4. Eligibility

You must be at least 13 years old to use OneAthlete. If you are under the age of majority where you live, you may use the app only with permission from a parent or legal guardian.

5. Your Content

You are responsible for information you enter into the app, including profile details, reflections, and coach messages.

You grant us the limited rights needed to operate the app, including processing your content to provide app features and sending relevant content to service providers when you use the AI coach.

Do not submit content that you do not have the right to use, confidential team information, trade secrets, or private information about another person without permission.

6. AI Coach

The mental-performance coach uses artificial intelligence. Its responses may be incomplete, inaccurate, or inappropriate, and it may misunderstand your situation or miss important context.

Use your own judgment. Do not rely on AI responses as professional advice or as the sole basis for a high-stakes decision.

You agree not to use the AI coach to:

• Break the law or encourage unlawful or harmful conduct.
• Harass, threaten, abuse, or harm others.
• Infringe another person's rights.
• Share confidential information you are not allowed to disclose.
• Reverse engineer, disrupt, overload, or misuse the app or its service providers.

7. Subscriptions, Trials, and Billing

OneAthlete offers auto-renewable subscriptions through Apple's in-app purchase system. Subscription options may include a yearly plan and a monthly plan. An eligible yearly subscription may include a three-day free trial.

Prices, trial eligibility, currencies, taxes, and subscription periods may vary. The exact price and terms displayed by Apple before purchase govern your transaction.

Subscriptions renew automatically unless canceled through Apple before the end of the current period, subject to Apple's rules. Apple handles billing, renewals, cancellations, and refunds. You can manage or cancel a subscription through your Apple ID subscription settings.

Deleting OneAthlete or deleting local app data does not cancel your subscription.

8. Refunds

Purchases made through the App Store are handled by Apple. Refund requests must be submitted to Apple and are subject to Apple's refund policies and applicable law.

9. Local Data and Deletion

OneAthlete is currently local-first and does not require an account. App data is stored on your device unless you use a feature requiring external processing, such as the AI coach.

You can clear coach history or delete all app data from Settings. Deleting local data does not cancel an Apple subscription.

10. App Availability and Changes

We may update, modify, suspend, or discontinue parts of OneAthlete. We may add or remove features, content, subscription options, or pricing.

We do not guarantee that every feature, session, or AI response will always be available or error-free.

11. Acceptable Use

You agree not to:

• Use OneAthlete for unlawful, fraudulent, abusive, or harmful purposes.
• Interfere with the app, servers, networks, purchases, subscriptions, or security systems.
• Attempt to bypass payment, entitlement, rate-limit, or access controls.
• Copy, redistribute, modify, reverse engineer, or create derivative works from the app or its content except where permitted by law.
• Use the app to collect or process another person's personal information without permission.

12. Intellectual Property

OneAthlete, including its software, design, branding, sessions, audio, text, and other content, is owned by OneAthlete or its licensors and is protected by intellectual-property laws.

Subject to these Terms and any applicable subscription, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to use OneAthlete for your own non-commercial purposes.

13. Third-Party Services

OneAthlete relies on third-party services, including Apple for distribution, purchases, subscriptions, permissions, and notifications; Cloudflare for routing and protecting AI requests; and OpenAI for AI coach responses.

Third-party services are governed by their own terms and policies. We are not responsible for third-party services outside our reasonable control.

14. Disclaimers

OneAthlete is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of any kind, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

We do not guarantee any particular athletic, competitive, health, sleep, or performance outcome.

15. Limitation of Liability

To the fullest extent permitted by law, OneAthlete and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, injury, competition results, or decisions made based on the app.

Where liability cannot be excluded, our total liability for claims relating to OneAthlete will not exceed the amount you paid for the app in the 12 months before the claim or the minimum amount required by applicable law, whichever is greater.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

16. Termination

You may stop using OneAthlete at any time. We may suspend or terminate access if you violate these Terms, misuse the app, create risk for us or others, or if we discontinue the service.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and applicable legal provisions.

17. Changes to These Terms

We may update these Terms. If we make material changes, we will update the effective date and, where appropriate, notify you in the app or through the App Store.

Your continued use of OneAthlete after updated Terms take effect means you accept the updated Terms.
